The session will provide a review of the arsenal of regulatory enforcement actions that CMS, state Medicaid agencies and the OIG can and do utilize in determining whether a given provider is compliant with regulatory requirements, and if not, what actions they can take against the provider, including the following:

• CMS’s and the state Medicaid agencies’ increased use of revocation, termination and preclusion actions and the downstream implications of such actions
• The ability for Medicare and Medicaid programs to cross terminate providers from their respective programs
• OIG civil monetary penalties and exclusions
• Payment suspensions
• Future developments on the horizon
